Losing your job without notice can create serious financial and personal problems. However, an employer in the UAE cannot terminate an employee immediately without following the conditions set by labour law.

Under UAE employment law, immediate termination is allowed in specific circumstances. Employers must have a valid legal reason and follow the required procedure. Employees also have rights when their employment ends without notice.

If your employer has suddenly dismissed you, it is important to understand whether the decision was lawful, what payments you are entitled to, and what steps you should take next.

This guide explains immediate termination UAE, the legal grounds for dismissal, immediate termination clauses, and the practical steps employees should take after receiving a termination notice.

What Is Immediate Termination Under UAE Labour Law?

Immediate termination means an employer ends an employee’s contract without requiring them to work through the normal notice period.

In the UAE private sector, employment termination is mainly governed by Federal Decree-Law No. 33 of 2021, as amended. Article 44 explains when an employer can dismiss an employee without notice.

However, immediate termination does not mean an employer can dismiss someone whenever they want. The employer must establish one of the legal grounds listed under Article 44.

There is also an important difference between:

  • Termination with notice: The employer gives the employee a notice period, usually between 30 and 90 days, as stated in the employment contract.
  • Termination without notice: The employer ends the contract immediately under a legally recognised ground.
  • Unlawful termination: The employer dismisses an employee in circumstances that violate the law, such as dismissing them because they filed a genuine labour complaint.

The applicable law also requires employers to settle employees’ outstanding entitlements after employment ends.

When Can an Employer Terminate an Employee Immediately in the UAE?

Article 44 allows an employer to dismiss an employee without notice in specific circumstances. These include:

Legal groundWhat it means
False identity or documentsThe employee uses another person’s identity or submits forged certificates or documents.
Serious financial damageThe employee causes substantial financial loss or deliberately damages company property, subject to the legal reporting requirement.
Safety violationsThe employee ignores written workplace safety instructions that were clearly displayed and communicated.
Failure to perform dutiesThe employee repeatedly fails to perform basic contractual duties despite a written investigation and two warnings of dismissal if the behaviour continues.
Disclosure of confidential informationThe employee shares company secrets or intellectual property information, causing damage, loss of opportunity or personal gain.
Intoxication at workThe employee is found drunk or under the influence of prohibited drugs during working hours.
Workplace assaultThe employee assaults the employer, manager, supervisor or colleagues in a manner punishable under UAE law.
Unauthorised absenceThe employee is absent without a legitimate reason for more than 20 non-consecutive days or seven consecutive days.
Misuse of positionThe employee illegally uses their job position to obtain personal benefits.
Joining another establishment unlawfullyThe employee joins another establishment without following the applicable legal rules and procedures.

These grounds are not simply reasons an employer can mention in a termination letter. The employer must be able to establish the relevant circumstances.

For example, if an employee makes a mistake at work, the employer cannot automatically use that mistake as a reason for immediate termination. The mistake must meet the legal requirements for the relevant Article 44 ground.

What Should You Do If Your Employer Immediately Terminates You?

An unexpected dismissal can be stressful, especially when you have financial responsibilities or no alternative job. However, taking the right steps can help protect your employment rights and get termination benefits in UAE.

Here is what you should do if your company terminates your employment immediately.

1. Ask for a Written Termination Letter

Do not rely only on a phone call, meeting or verbal announcement.

Ask your employer to provide an official termination letter explaining:

  • Why your employment is ending.
  • The effective termination date.
  • Whether the company is relying on Article 44.
  • What final payments you will receive.

Keep the letter somewhere safe. It may be important if you later challenge the dismissal.

2. Check Whether the Employer Followed Article 44

Compare the reason in your termination letter with the legal grounds under Article 44.

For example, if your employer dismisses you for poor performance, check whether the required written investigation and two warnings were given.

If the employer accuses you of misconduct, ask what evidence supports the allegation.

A company cannot make an immediate termination lawful simply by describing an employee’s actions as serious misconduct.

3. Collect Your Employment Documents

Keep copies of all documents that may support your position.

These include:

  • Employment contract and amendments.
  • Salary slips and bank statements.
  • Termination letter.
  • Emails and messages with HR or management.
  • Previous warnings or performance reviews.
  • Attendance records.
  • Evidence related to the employer’s allegations.

Do not access, copy or take confidential company information without authorisation. Keep only documents you are legally entitled to retain.

4. Check Your Final Salary and Other Payments

An immediate termination does not automatically cancel your financial entitlements.

Depending on your circumstances, your employer may need to pay:

  • Unpaid salary up to the termination date.
  • Unused annual leave entitlement, calculated according to applicable law.
  • End-of-service gratuity, if you qualify.
  • Any outstanding contractual payments.
  • Notice period compensation, if the dismissal does not legally qualify for termination without notice.

Under Article 53, the employer must pay the employee’s wages and other entitlements within 14 days from the date the employment contract ends.

For eligible foreign full-time employees, end-of-service gratuity is generally calculated using basic salary. Employees who have completed at least one year of continuous service may qualify for gratuity under Article 51.

5. Do Not Sign Documents You Do Not Understand

HR may ask you to sign a termination acknowledgement, resignation letter or final settlement document.

Read every document carefully before signing.

In particular:

  • Check whether the document incorrectly describes the termination as a resignation.
  • Verify the final payment calculation.
  • Check whether any outstanding salary or benefits are missing.
  • Ask for a copy of every document you sign.

If you disagree with the reason for termination or the payment amount, communicate your concerns in writing.

6. File a Labour Complaint If You Believe the Termination Was Unlawful

If your employer has not followed the legal procedure or you believe your dismissal violates your rights, you can contact the Ministry of Human Resources and Emiratisation (MoHRE).

Explain the situation and provide the relevant documents.

MoHRE can review the complaint and attempt to resolve the dispute between you and your employer. If an agreement cannot be reached, the dispute may proceed to the competent court under the applicable procedure.

You can use MoHRE’s official website or contact its call centre at 600 590 000.

Do not delay seeking advice or filing a complaint, especially if there are deadlines or visa-related concerns.

Can an Employee Receive Compensation After Immediate Termination?

Yes, an employee may be entitled to compensation depending on the circumstances of dismissal.

1. Immediate termination without valid legal grounds

There are two important situations to understand.

If an employer cannot establish a valid Article 44 ground, the employee may challenge the termination and claim any payments legally due, including notice compensation where applicable.

Under Article 43, the normal notice period must be between 30 and 90 days. If the required notice is not provided and the termination does not qualify for an exception, notice compensation may be payable.

2. Unlawful termination under Article 47

Article 47 specifically protects employees dismissed because they filed a serious complaint with MoHRE or brought a lawsuit against their employer that is proven to be valid.

If the court establishes unlawful termination, it may award compensation of up to three months’ wages, based on the employee’s last wage.

This compensation is separate from eligible notice pay and end-of-service gratuity.

It is important to understand that not every disputed or procedurally incorrect dismissal automatically qualifies for Article 47 compensation. The legal reason for dismissal matters.

Does Immediate Termination Affect Your UAE Residence Visa?

When employment ends, the employer and employee must follow the applicable work permit and residence visa cancellation procedures.

If your employer terminates your contract, ask HR for confirmation of the cancellation process and the relevant dates.

Do not assume that your residence visa remains valid for an unlimited period after employment ends. The permitted stay after cancellation depends on your visa category and immigration rules.

If you plan to join another company, check the requirements for obtaining a new work permit before starting your next job.

Employees should also keep copies of their cancellation documents and final settlement records.

Final Thoughts

Immediate termination in the UAE is permitted, but employers must follow the conditions set by labour law. A termination letter alone does not make a dismissal legally valid.

Employees should understand the reason for dismissal, request written documentation, check their final payments and keep evidence of all employment-related communication.

If the employer has not followed the required procedure or the dismissal appears unlawful, contacting MoHRE is a practical first step.
